Who is an employee? Who is an independent contractor?

The Independent Contractors Act 2006 (IC Act) and the Fair Work Act 2009 (FW Act) protect the rights and entitlements of independent contractors.

The difference between an employee and independent contractor is based on many different factors. No single factor determines whether a person is an employee or contractor. Instead, courts will look at each case and make a decision based on the totality of the relationship between the parties when determining the status of a person’s employment.

There are some common factors that may contribute to determining whether a person is an employee or independent contractor. Please download the attached Fact Sheet and check with Fair Work South Australia if you are unsure.

Terms and Conditions
An independent contractor is not an employee and has no right to employee entitlements. Independent contractors will provide high quality skilled services and specialised equipment, tools and ladders to complete all specified works when engaged by B & V Ceilings (SA) Pty Ltd.

Independent contractors are responsible for the workmanship provided both personally or by any of their staff and are liable for the costs associated with rectifying defects.

All work carried out by independent contractors are to be guaranteed in accordance with industry standards.

It is the responsibility of independent contractors to maintain all relevant insurances and may be requested by B & V Ceilings (SA) Pty Ltd to provide evidence of such compliance.

In the best interests and safety of all persons at job sites, it is a strict requirement that independent contractors at all times comply with industry quality management and safety requirements.

Site access times agreed by B & V Ceilings (SA) Pty Ltd with head contractors are generally between the hours of 7 am and 3 pm, Monday to Saturday, however are subject to change from time to time.

It is the responsibility of independent contractors to confirm site access times or arrange for alternative access times.

Invoice Requirements*
Invoices should be emailed to accounts@bvceilings.com COB Tuesday.

The agreed project sum per job is to not exceed the original purchase order value.

Approved invoices will be scheduled for payment the following Wednesday to the nominated bank account.

Information required on invoices in accordance with taxation laws: Approved invoices must outline the following:
1. Name of entity
2. Address of entity
3. ABN of entity
4. Unique Invoice number
5. Date of invoice
6. Site or Project Name
7. Purchase Order Number
8. Materials & Labour
9. Invoice amount excluding GST
10. GST charged (if applicable)

All payments made to subcontractors from 1 July 2012 will be reported annually to the Australian Taxation Office as per new reporting regulations.
